Legal Steps to Take After Being Scammed Online in India
Being scammed online can feel overwhelming. But the legal system in India has well-defined steps that can help you recover money, get the offender prosecuted, and protect yourself from further harm. Here is exactly what to do.
Immediate Steps — Do This Within Hours
Call 1930. This helpline connects you to cyber crime authorities and initiates bank coordination. Even if you are unsure, call first.
Contact your bank. Inform them of the fraud. Ask to freeze the beneficiary account and request a reversal.
Block your compromised account / card / UPI. Stop any further damage.
Preserve evidence. Do not delete any messages, emails, or transaction records.
Legal Steps to Take
File a Complaint on cybercrime.gov.in
This is the official government portal for registering cyber crime complaints. Select the appropriate category, provide all transaction details, and upload screenshots. You will receive a complaint number — track the case online.
File an FIR
For larger amounts or complex scams, visit a Cyber Crime Police Station. Provide your complaint portal number, bank details, and all evidence. An FIR triggers formal investigation and gives police power to compel banks, telecom providers, and platforms to cooperate.
Send a Legal Notice to the Fraudster
If you know the identity of the fraudster (or the fraudulent company), a lawyer can send a legal notice demanding repayment. This creates a formal record and is often the first step before filing a civil recovery suit.
File a Consumer Complaint
If a platform, bank, or payment app was negligent in preventing or responding to the fraud, file a complaint at your local Consumer Dispute Redressal Commission under the Consumer Protection Act, 2019.
Common Types of Online Scams and the Right Legal Response
UPI / QR Code Fraud: Call 1930, file on cybercrime.gov.in, and contact your UPI app (PhonePe, GPay, Paytm) directly.
Fake Job Offers: FIR under BNS for cheating. Report to the company being impersonated.
Fake Investment Schemes: Report to SEBI and police. File under IT Act and BNS.
Phishing Emails / Fake Websites: Forward to CERT-In (incident@cert-in.org.in) and file on the cyber crime portal.

The scammer is in another state or country. Can anything be done? Yes. Cyber crime police have jurisdiction across India, and INTERPOL coordination is available for international cases.
I gave my OTP out of confusion. Am I liable? Criminally, the scammer is liable. Your RBI consumer protection may be reduced, but a legal complaint is still valid and important to file.
